1. About this policy

Westown is a mixed-use precinct in Shongweni, KwaZulu-Natal. For purposes of this Privacy Policy, “Westown”, “we”, “us” and “our” refer to Fundamentum Dev Co. (Pty) Ltd, registration number 2016/357982/07, the operator of westown.co.za and the responsible party for the personal information described in this policy.

This policy explains how we collect, use, share, store and protect personal information when you use our website, submit an enquiry, subscribe to communications, attend or enquire about an event, or otherwise interact with us. It should be read with our Terms of Use and any specific notice presented when information is collected.

We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”) and other applicable South African law.

2. Personal information we collect

Depending on how you interact with Westown, we may collect:

  •   identity and contact information, including your name, surname, organisation, email address, telephone number and physical or postal address;
  •   enquiry information, including your selected area of interest, message, property, leasing, investment, residential, development, event or general-enquiry requirements;
  •   marketing preferences and records of your consent, objections, opt-outs and communication choices;
  •   correspondence and interaction records, including emails, calls, form submissions, complaints and feedback;
  •   technical and usage information, such as your IP address, browser and device type, approximate location, referring pages, pages visited, dates, times and cookie identifiers;
  •   event or competition information where applicable, including entry details, attendance information, photographs or recordings where appropriate notices have been provided; and
  •   any other information you choose to provide to us.

Please do not submit unnecessary special personal information, financial information or identity documents through a general website enquiry form.

3. How we collect information

We may collect personal information:

  •   directly from you when you complete a form, contact us, subscribe, register, enter a promotion or interact with us;
  •   automatically through cookies, server logs, analytics and similar technologies when you use the website;
  •   from a representative acting on your behalf;
  •   from Westown’s authorised development, management, leasing, sales, event or service partners where it is lawful and relevant; and
  •   from public sources or social-media platforms where you have made information public or interacted with an official Westown account.

4. Why we use personal information

We may process personal information to:

  •   receive, route, manage and respond to your enquiry;
  •   connect you with the appropriate Westown team member, developer, leasing or sales representative, precinct partner or service provider;
  •   provide information you request about Westown, its precincts, opportunities, facilities, events and activities;
  •   manage subscriptions and send marketing communications where you have consented or where otherwise permitted by law;
  •   administer events, promotions, competitions, surveys and feedback;
  •   operate, secure, analyse and improve the website, our communications and user experience;
  •   maintain records, prevent fraud or misuse, establish or defend legal rights, and meet legal, regulatory and governance obligations; and
  •   carry out other compatible purposes explained to you when information is collected.

We rely on one or more lawful grounds recognised by POPIA, including your consent, the performance or conclusion of an agreement, compliance with a legal obligation, the protection of a legitimate interest, or another ground permitted by law.

5. Enquiries and relevant Westown partners

When you submit an enquiry, we may send your information to the person or organisation best placed to respond. Depending on your selected area of interest, this may include a Westown development or management team, property developer, leasing agent, sales agent, event operator, tenant, professional adviser or other authorised precinct partner.

We will share only information reasonably required to address the enquiry. A recipient may act as our operator or as a separate responsible party, depending on its role. Where a recipient acts as a separate responsible party, its own privacy notice may also apply.

6. Direct marketing

Submitting an enquiry does not automatically subscribe you to marketing communications. Where the website offers an optional marketing tick box, we will use your details for marketing only if you actively opt in or where another lawful basis permits it.

Marketing may include news, development updates, opportunities, events and other communications relating to Westown. You may unsubscribe at any time by using the link in a message or by contacting us at info@westown.co.za.

While we will endeavour to process your unsubscribe request as soon as reasonably practicable, please allow a reasonable period for your request to be implemented. During this time, you may continue to receive communications that have already been scheduled, are in the process of being distributed, or form part of an existing automated campaign.

Withdrawing your consent does not affect processing that occurred lawfully before the withdrawal, and we may retain a limited suppression record to ensure that your marketing preferences are respected and to prevent future marketing communications.

7. Cookies and website analytics

  •   the relevant Westown teams and authorised partners described in section 5;
  •   technology, hosting, analytics, communications, customer-management, security and professional-service providers that assist us;
  •   our auditors, insurers, attorneys and other professional advisers;
  •   a purchaser, successor or transaction adviser in connection with a lawful corporate or property transaction;
  •   law-enforcement bodies, courts, regulators or public authorities where required or permitted by law; and
  •   other parties where you consent or where disclosure is otherwise lawful.

Where a service provider processes information on our behalf, we require appropriate confidentiality and security commitments as contemplated by POPIA.

9. Cross-border processing

Some service providers or systems may process or store information outside South Africa. Where personal information is transferred across borders, we will take steps required by POPIA, including ensuring an adequate level of protection, an appropriate agreement, your consent where required, or another lawful basis for the transfer.

10. Retention

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected, to meet legal or contractual requirements, resolve disputes, enforce rights, maintain appropriate business records or honour an opt-out. We will delete, destroy or de-identify information when it is no longer required, subject to applicable law.

11. Security

We use reasonable technical and organisational safeguards to protect personal information against loss, damage, unauthorised destruction, access, use, alteration or disclosure. No internet transmission or storage system is completely secure, and we cannot guarantee absolute security.

Where required by law, we will notify the Information Regulator and affected persons of a security compromise in accordance with POPIA.

12. Your rights

Subject to POPIA and other applicable law, you may:

  •   ask whether we hold personal information about you and request access to it;
  •   ask us to correct, update, delete or destroy inaccurate, irrelevant, excessive, outdated, incomplete, misleading or unlawfully obtained information;
  •   object to processing on reasonable grounds where POPIA permits;
  •   object at any time to direct marketing;
  •   withdraw consent where processing is based on consent;
  •   request information about recipients or categories of recipients, where applicable; and
  •   lodge a complaint with the Information Regulator.

13. Children

The website is intended for a general audience and is not designed to collect personal information directly from children. If information about a child must be processed for an event, activity or other legitimate purpose, we will do so only where permitted by POPIA and, where required, with the authorisation of a competent person.

14. Third-party websites and platforms

The website may link to third-party websites, social-media pages, maps, booking services, developer sites, tenant sites or other platforms. Those parties control their own privacy practices. We encourage you to read their privacy notices before providing information.

15. Changes to this policy

We may update this policy from time to time. The current version and effective date will be published on the website. Material changes may be communicated through the website or another appropriate channel.
